Former President Donald Trump’s legal team is gearing up for another showdown in court as they seek to dismiss special counsel Jack Smith’s case against him regarding the retention of classified documents. In a hearing in Florida, Trump’s lawyers will argue that he is protected from prosecution by a federal recordkeeping law and that there are unresolved legal issues surrounding the charges he faces.
This will be the second time in as many weeks that Trump’s team will confront prosecutors in court. Smith has accused Trump of unlawfully retaining classified government records and obstructing investigations during his presidential transition, totaling 32 counts.
Trump’s defense contends that as president, he had the authority to designate certain documents as personal and out of reach of scrutiny. They argue that the Presidential Records Act bars judicial oversight of his recordkeeping practices. On the other hand, prosecutors assert that the documents Trump allegedly held onto are government property, not personal, and fall under the purview of the law.
In a twist, FBI searches revealed hundreds of additional documents stashed in unsecured locations at Trump’s Mar-a-Lago estate, despite Trump returning some materials in January 2022. The legal battle also encompasses charges related to the Espionage Act, which Trump’s legal team deems unconstitutional due to ambiguous legal grounds.
There are ongoing disputes regarding claims of vindictive prosecution and presidential immunity, with the latter issue scheduled for review by the Supreme Court next month. Prosecutors insist that Trump’s defense is intentionally delaying the trial, which they argue should commence in July.
This latest court hearing follows a recent development where a county judge in Georgia dismissed charges against Trump in a separate case. Trump has been granted an extension to submit additional documentation in relation to the dismissal motions as the legal saga continues.
